Welcome to Evinta. These Terms and Conditions ("Terms", "Agreement") govern your use of the Evinta mobile application and services (collectively, the "Service") operated by Evinta ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Evinta is an AI-powered finance and expense tracking application that automatically reads transaction SMS messages from your financial institutions to provide real-time expense tracking and financial insights.

Our Service includes:

• Automatic Transaction Tracking: Reading and processing SMS messages from banks and financial institutions to extract transaction information
• AI-Powered Categorization: Automatically categorizing expenses and income using artificial intelligence
• Financial Analytics: Providing insights, reports, and visualizations of your spending patterns
• Multi-Account Support: Managing multiple bank accounts and financial institutions in one place
• Budget Management: Setting and tracking budgets across various categories

Account Creation

To use Evinta, you must create an account by providing accurate, current, and complete information. You agree to:

• Provide truthful and accurate information during registration
• Maintain and promptly update your account information
• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not create an account if you have been previously banned from our Service

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Not sharing your account with others

We reserve the right to suspend or terminate your account if we suspect unauthorized use or security concerns.

Evinta requires permission to read SMS messages on your device to provide automatic transaction tracking. By granting SMS access, you acknowledge and agree that:

• We will read SMS messages from recognized financial institutions and payment services
• We will not read personal messages, OTPs for other services, or non-financial SMS
• Transaction data extracted from SMS will be processed and stored in accordance with our Privacy Policy
• You have the legal right to grant us access to these SMS messages

Permission Withdrawal

You may revoke SMS permissions at any time through your device settings. However, this will disable automatic transaction tracking, and certain features of the Service will not function properly.

Accuracy of Information

While we strive for accuracy, we cannot guarantee that all transaction information extracted from SMS messages is 100% accurate. You are responsible for reviewing and verifying the accuracy of your transaction data. We are not liable for any errors or omissions in automatically extracted information.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or related systems
• Use any automated system, including robots or spiders, to access the Service without our permission
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Share financial data from the Service with unauthorized third parties
• Use the Service for any commercial purpose without our explicit permission
• Upload or transmit viruses, malware, or any other malicious code

Data Sources

The financial data displayed in Evinta is derived from SMS messages sent by your financial institutions. We act as a passive recipient and processor of this information. We do not:

• Have direct access to your bank accounts
• Control the content or timing of SMS messages from financial institutions
• Guarantee the completeness of transaction data
• Have the ability to initiate transactions on your behalf

No Financial Advice

Evinta is a tool for tracking and organizing your financial information. We do not provide financial, investment, tax, or legal advice. The Service is not intended to be a substitute for professional financial advice. You should consult with qualified professionals before making financial decisions.

User Responsibility

You acknowledge that:

• You are solely responsible for your financial decisions and transactions
• You should verify all financial information with your official bank statements
• We are not responsible for any financial losses resulting from your use of the Service
• The insights and categorizations provided by our AI are suggestions and may not always be accurate

Subscription Plans

Evinta offers various subscription plans with different features and pricing. By subscribing to a paid plan, you agree to:

• Pay the subscription fees associated with your chosen plan
• Provide accurate and complete payment information
• Allow automatic renewal unless you cancel before the renewal date
• Accept that subscription fees are non-refundable except as required by law

Free Trial

We may offer a free trial period for certain subscription plans. You must provide payment information to start a free trial. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

Billing and Renewal

• Subscriptions automatically renew at the end of each billing period
• You will be charged the then-current rate for your subscription plan
• We reserve the right to change subscription prices with 30 days' notice
• Price changes will not affect your current billing period

Cancellation and Refunds

You may cancel your subscription at any time through the app or by contacting support. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial subscription periods except as required by applicable law or at our sole discretion.

Our Property

The Service and its original content, features, and functionality are owned by Evinta and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes but is not limited to:

• Software code, algorithms, and AI models
• Design, layout, and user interface
• Logos, trademarks, and brand elements
• Documentation and content

Your Data

You retain ownership of all financial data and content you input or that is extracted from your SMS messages. By using the Service, you grant us a limited license to use, process, and store your data solely for the purpose of providing the Service to you.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use, modify, and incorporate such feedback without any obligation to compensate you.

• Business interruption or loss of goodwill
• Unauthorized access to your data despite our security measures

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability shall be limited to the maximum extent permitted by law.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees that the Service will be uninterrupted, secure, or error-free
• Accuracy, reliability, or completeness of any information or data
• That defects will be corrected or that the Service is free of viruses or harmful components

You agree to indemnify, defend, and hold harmless Evinta and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any content or data you submit through the Service

Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the app

Upon termination, you will lose access to the Service and your data may be deleted in accordance with our data retention policies.

Termination by Us

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• Upon your request
• Discontinuation of the Service

Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and data (subject to legal retention requirements)
• You remain liable for any outstanding fees or charges
• Provisions of these Terms that should survive termination will remain in effect

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, pandemics, government actions, or failures of third-party services or infrastructure.
